  1. Preliminary information:
    • You must be 13 years of age or older as of September 17, 2006 to vote for your favorite design;
    • You may cast only one vote per e-mail address.
    • Voting begins at 12:01 a.m. on September 17, 2006 and all votes must be received by no later than 5:59 P.M. EST on October 16, 2006 (the “Voting Period”). Votes received after 5:59 P.M. EST on October 16, 2006 will not be counted.
    • The winner will be announced on October 18, 2006 at the National Design Awards Gala in New York City.
    • No purchase or payment of any kind is necessary to vote.
    • All decisions regarding the voting process shall be final and shall not be subject to challenge or appeal.

  2. How to Vote:
    • Beginning on September 17, 2006, log on to www.cooperhewitt.org and follow the directions to vote for your favorite nominee or to submit your own nomination for your favorite design of the year;
    • You may vote for specified designs or nominate your favorite design;
    • The design that receives the greatest number of votes during the Voting Period will be declared the winner.
    • In the event of a tie, the Cooper-Hewitt, National Design Museum will decide which of the tied choices is the better choice in its own discretion.

  3. Ownership:
    • This Site is owned by the Smithsonian and content on the Site is owned by the Smithsonian and by third parties, and is posted on the Site solely for purposes of the People’s Design Award.
    • All content on the Site is protected by copyright and trademark laws and must only be used for personal, non-commercial purposes. Any other use, reproduction, publication, copying or transmission of content from this Site might infringe the legal rights of third parties and subject the user to possible liability.
    • You may nominate your favorite design by uploading files and content solely in connection with this Site. You are solely responsible for such files and content and the Smithsonian has no control over, and accepts no responsibility whatsoever in connection with or arising from, such files and content.
    • All votes and voting data become the sole property of the Smithsonian and will not be acknowledged or returned. The Smithsonian shall have the right to collect, store and use all email addresses submitted hereunder (including addresses you provide if you forward this Site to another user). Such uses shall be in accordance with the Smithsonian privacy policy, www.si.edu/privacy. By submitting an email address, participants hereby agree to the Smithsonian’s collection and usage of personal information and acknowledge that they have read and accepted the Smithsonian’s privacy policy.
    • The Smithsonian reserves the right to monitor this Site but assumes no responsibility for actively monitoring the Site for inappropriate content.
    • The Smithsonian reserves the right to prevent you from submitting files in violation of these terms and may, among other remedies, remove any such files or content in our sole discretion.

  4. Prohibited Content and/or Activity
    • This Site must be used in a manner consistent with these rules and any and all applicable laws and regulations.
    • Smithsonian reserves the right to take appropriate action against anyone who violates these rules, including without limitation, removing the offending content from the Site, disqualifying the vote, terminating your use of, or access to, this Site, or taking other action deemed appropriate in the Smithsonian’s sole discretion.
    • Prohibited activities include posting content or engaging in conduct that:
      1. is obscene, patently offensive, abusive, threatening, harmful, harassing, defamatory or libelous;
      2. contains nudity, violence or offensive subject matter;
      3. contains content related to alcohol, firearms or tobacco;
      4. involves the transmission of spam or junk mail;
      5. exploits people in a sexual or violent manner;
      6. violates the copyright, trademark or other intellectual property rights or privacy rights of any person;
      7. furthers or promotes any criminal activity or provides instructional information about illegal activities;
      8. provides or creates computer viruses;
      9. involves advertising, solicitation or sales activities;
      10. interferes with, disrupts or tampers with the voting process or with this Site;
      11. is determined by the Smithsonian, in its sole discretion, to be inappropriate or unacceptable.

  5. Disclaimer:
    • The Smithsonian shall have the right to void any vote that appears, in the Smithsonian’s sole discretion, to have been made by a person not meeting the eligibility requirements set forth above.
    • The Smithsonian reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend voting for any reason, including corruption or interference with this Site by any virus, bug, non-authorized human intervention, fraud or other causes beyond its control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the voting process.
    • Smithsonian is not responsible for telecommunications, network, electronic, technical, or computer failures of any kind, incomplete or inaccurate transcription of voting information, any human or electronic error, or for votes that are incomplete, stolen, misdirected, jumbled, garbled, or delayed by computer transmissions. In the event of technical difficulties, Smithsonian reserves the right to take any appropriate action, including, without limitation, voiding the votes cast during the time period in which such technical difficulties occurred and declaring a winner based upon the vote up to that point.
    • Smithsonian and its officers, directors, employees, and agents assume no responsibility for any injury or damages of any kind to participants or to any person’s computer relating to or resulting from voting, entering, uploading or downloading materials or any other use in connection with this Site.
    • Smithsonian will use reasonable efforts to ensure the security and accuracy of all votes and the voting process, but makes no warranties, whether express or implied, regarding this Site.
    • These rules are subject to change at any time without notice at the sole discretion of the Smithsonian. Changes will be posted on this Site.
